It is divided into 5 chapters. Chapter 1 deals with duties and obligations of the Plant Production and Protection Service (created by Decree No. 56/77 of 25 June 1977). This Service is responsible for: guaranteeing plant protection; fighting harmful agents in plants; preventing the introduction of such harmful agents through imports; guaranteeing exclusive importation rights; authorizing the distribution and controlling the use of pesticides. Article 2 defines "harmful agents in plants", "phytosanitary inspector", etc. Chapter 2 deals with phytosanitary controls, establishing: (a) the obligations of private or legal entities responsible for phytosanitary controls on agricultural products and their notification to the Ministry of Rural Development or to local authorities; (b) a list of plant enemies (established by Decree of the Ministry of Rural Development), etc. Article 7 states that if any local authority traces new plant enemies it must inform the Plant Protection Service. Article 8 deals with the competencies and obligations of phytosanitary inspectors. Chapter 3 establishes phytosanitary measures regarding imports and exports (administrative procedures, plant health certificates, etc.). Chapter 4 regulates pesticide control for agricultural uses. The import and trade of pesticides for agricultural use are under the strict competence of the Ministry of Rural Development. For all matters concerning the use of pesticides in agricultural lands, an inter-ministerial committee (created by art. 21) shall be competent. Texto completo Portugués
