This Act enters into force immediately.
Resumen

The present Act lays down rules on breeder's rights to the intellectual property related to the discovery or development of new plant varieties. It contains 28 articles organized in the following chapters: I. General provisions; II. Application; III. Research and registration; IV. Cultivation rights; V. Penalties, etc. According to Article 1, a person who cultivates, discovers, or develops a new plant variety or acquires the right to it, the owner of the variety may, according to this Act, acquire the exclusive right to exploit it for commercial purposes. This right is granted on the basis of an application to the Icelandic Food and Veterinary Authority. The Act covers cultivars of all genera and species of plants, including hybrid genera and species. The conditions for granting a plant variety right are laid down in Article 2 and include the requirement that the variety be clearly special, i.e., it can be clearly distinguished from other varieties known on the date of application. The entitlements granted by a plant variety right are described in detail.
