An environmental impact assessment shall be carried out by the Board in respect of an appeal of: (a) aquaculture of a class specified in regulation 5(1)(i) and (ii) of the Aquaculture (Licence Application) Regulations 1998; or (b) aquaculture of a class specified in Annex II of the Council Directive which the Board determines would be likely to have significant effects on the environment.
