Marine mammals listed as endangered or threatened and subject to these regulations may also be subject to additional requirements pursuant to the Marine Mammal Protection Act. No person shall take, import, export or engage in any other prohibited activity involving any species of fish or wildlife under the jurisdiction of the Secretary of Commerce that has been determined to be endangered under the EPA, or that has been determined to be threatened and for which the prohibitions of section 9(a)(1) of the EPA have been applied by regulation, without a valid permit issued pursuant to these Regulations. The Regulations also concern permits for incidental taking of species and permits for listed species of sea turtles involving the Fish and Wildlife Service. The Regulations also define observer requirements for U.S. vessels or any fishing vessel that is otherwise subject to the jurisdiction of the United States, operating in a fishery that is identified through the annual determination process. Subpart E concerns provisions on experimental populations of endangered or threatened species.
