Resumen
The plaintiffs claimed that the iron ore dust pollution produced by the defendant during port operation adversely affected the air quality and living environment of the surrounding residents. Besides, the defendant discharged untreated waste water containing red iron ore into the Yangtze River, which endangered the drinking water security. The plaintiff also claimed that industrial noised during port operation affected the residents in a negative way. A ruling was made by the court after the registration of the case to order immediate cessation of any activities that polluted environment. After a thorough investigation, the court found that the failure to apply an environmental impact assessment from environmental protection administration and failure to get authorization from construction administration before commencing iron ore transportation by the defendant at the port constitutes an illegal act. Port operation of the defendant polluted the surrounding air, ground and water. By mutual consent of both parties, the case closed by mediation.
