Abstract

Objectives: To establish international uniformity in the field of arrest of ships. Summary of provisions: Art. 1 defines the terms covered by the Convention. Parties agree that a ship may be arrested or released from arrest only under the authority of a Court of the State Party in which the arrest is effected, and that it may be arrested only in respect of maritime claims, for the purpose of obtaining security (art. 2). Following articles provide for the exercise of right of arrest (art. 3), release from arrest when sufficient security has been provided in a satisfactory form (art. 4), right of rearrest and multiple arrest (art. 5), protection of owners and demise charterers of arrested ships (art. 6), and jurisdiction on the merits of the case (art. 7). The Convention is to apply to any ship within the jurisdiction of any State Party, whether or not that ship is flying the flag of a State Party (art. 8).
