Abstract

In the four years since its creation, the U.S. Environmental Protection Agency 's Environmental Appeals Board has resolved more than 500 matters and published over 140 formal opinions in a broad array of cases. This article surveys the body of environmental administrative law developed by the Board, and provides an overview of the principles used to decide cases appealed to the Board. Furthermore, the authors hope to provide the public and practitioners with insight into the Board 's decisionmakingg processes
