The present Act enters into force on 1 February 1988.

Abstract

This Act introduces legal procedures aimed at managing, conserving and enhancing the wildlife resource of the province of Manitoba. It has 94 sections, and is divided up into 5 parts plus schedules as follows: PART I Designated Areas; PART II Offences; PART III Licensing; PART IV Enforcement; PART V General and Schedule A which lists animals that have been prescribed as wild. The Act allows the Lieutenant Governor in Council to designate Crown land into for example: wildlife management areas; special trapping areas; animal control areas; and wildlife refuges. The Act also provides for various offences which are grouped under the following: Dangerous Hunting Offences; Hunting and Trapping Offences; Fur Bearing Animal Offences; and General Offences. Under general offences matters such as Possession of live wild animals; the killing of certain wildlife in defence of property; transporting, importing or exporting offences; and the destruction of nest, eggs or habitat is dealt with. The minister may appoint officers for the purpose of enforcing this Act and their powers and duties are set out dealing with inspection, arrest, seizure and forfeiture. Section 90 sets out in detail the pertinent issues to be covered should the minister need to make regulations that are ancillary to this Act.
