Abstract

Section 3 declares taking or killing of "right" whales, immature whales or female whales accompanied by a calf, to be an offence. The same section defines "immature", "right whale" and other whales. No ship shall be used within coastal waters (three nautical miles measured from the low-water mark) for the taking or processing of whales and no factory for the processing of whales established unless a licence to do so has been obtained (sect. 4). Section 9 specifies conditions attached to licences. The conditions range from remuneration of crew to keeping of records and type of processing plants used. Section 10 concerns permits for the taking of whales for scientific use. Regulation making powers of the Governor in Council are set out in section 11. Section 16 regulates the taking of derelict whales. (17 sections completed by two Schedules; Schedule 1 contains a list of "right whales", blue whales and fin whales; Schedule 2 contains a form of licence)
