Abstract

This chapter of the Alaska Statutes adopts the Water Use Act. It states that the Department of Natural Resources determines and adjudicates rights in the water of the state, and in its appropriation and distribution. The chapter further provides for the authority and duties of the commissioner; water reserved to the people; appropriation or removal of water out of hydrologic units to other hydrologic units; water conservation fee; reservation of water for fish; sale of water by the state; right to appropriate; priority; existing rights; determination of existing rights; criteria for issuance of permit; preference in granting permits; terms of permit; abandonment, forfeiture, and reversion of appropriations; reservation of water; preferred use; authorization for temporary use of water; transfer and change of appropriations; administrative adjudications; federal reserved water rights; crimes; appeals; the Water Resources Board; enforcement and costs; and data collection authority.
