Abstract

This Part of Division 6 of the Water Code of California declares that groundwater management must be consistent with Section 2 of Article X of the California Constitution and further provides with respect to sustainable groundwater management in the larger part of California. The Act provides for local authorities being established as Groundwater Sustainability Agencies for high- and medium-priority groundwater basins and defines the functions and powers of such agencies. A groundwater sustainability agency may require registration of a groundwater extraction facility within the management area of the groundwater sustainability agency. A groundwater sustainability plan shall be developed and implemented for each medium- or high-priority basin by a groundwater sustainability agency to meet the sustainability goal established pursuant to this Part. The groundwater sustainability agency shall consider the interests of all beneficial uses and users of groundwater. The Act requires collaboration between and across agencies and stakeholders. It provides specific guidance regarding the role of Native American Tribes. A participating Tribe shall be eligible to participate fully in planning, financing, and management under this Act, including eligibility for grants and technical assistance, if any exercise of regulatory authority, enforcement, or imposition and collection of fees is pursuant to the Tribe's independent authority and not pursuant to authority granted to a groundwater sustainability agency under this Act.
