This Act shall enter into force on the day it is published on the Gazette.
Abstract

This Act consists of 45 sections divided into 6 Parts: Preliminary matters in Part 1, responsibilities for waste management in Part 2, general powers in relation to waste in Part 3, waste management operations in Part 4, offences relating to waste in Part 5, and miscellaneous provisions in Part 6. This Act sets forth the duties and responsibilities of the Director for the development, coordination and implementation of the Government’s waste and litter minimization policies and programs in accordance with the relevant international conventions and treaties. To this end, a National Waste Management Strategy will be developed by the Director with the aim of minimizing the generation of waste and waste going to landfill, while maximizing the recovery of resources and improving the management of residual waste using environmentally sound techniques suited to local conditions. The Director shall undertake an annual audit of the waste generation and disposal. All government agencies shall participate in the waste management activities, with a special emphasis on the Ministry of Health and the Department of Biosecurity in the collection and disposal of medical and hazardous waste. The Minister may impose requirements in relation to certain wastes that have adverse impacts on the environment or human health. A designated waste management operator shall promote the reduction, reuse and recycling of waste. Relevant Municipal Council or Provincial Government Council may be designated as waste management operator for each waste service area to carry out waste service responsibilities. A designated waste management operator must prepare and submit reports relating to any aspect of waste management under its responsibility to the Department, the Ministry of Health and the Department of Biosecurity. For the purposes of implementing and enforcing the provisions of this Act and monitoring and containing the effects of waste on human health and the environment, the duties of an authorized officer are listed in Section 40. The Minister may prescribe any fee imposed under this Act such as residential waste collection fee, commercial waste collection fee, fees for hazardous waste. The Minister may make regulations consistent with this Act for the effective implementation of the provisions of this Act.
