A corporation without share capital is hereby established to be known in English as “Waste Diversion Ontario” . It shall: a) develop, implement and operate waste diversion programmes for designated wastes in accordance with this Act and monitor the effectiveness and efficiency of those programmes; b) seek to enhance public awareness of and participation in waste diversion programmes; c) seek to ensure that waste diversion programmes developed under this Act affect Ontario’s marketplace in a fair manner; d) determine the amount of money required by Waste Diversion Ontario and the industry funding organizations to carry out their responsibilities under this Act; e) establish a dispute resolution process for: i) disputes between an industry funding organization and a municipality with respect to payments to the municipality under a waste diversion program, and ii) disputes between an industry funding organization and a person with respect to the person’s obligations; f) maintain a list of plans approved and ensure that the list is made available to the public; g) monitor the effectiveness of approved plans; h) conduct public consultations on any matter referred to Waste Diversion Ontario by the Minister.
