Abstract

This is a subsidiary legislation of the Vegetable Oil Refining (Licensing and Control) Law of Enugu State. These Regulations are made by the Commissioner for Commerce, Industry and Mineral Development of the State to provide for the procedure for obtaining the vegetable oil refining licence. It provides the forms for the entire procedure surrounding the obtaining of the licence. It makes it an offence to fail to produce the licence during an inspection by the Inspector who is to carry out inspection in the vegetable oil refining premises. The Regulations also provide stiff penalties for operating without licences, forging licences or obtaining same under false pretences. The Regulations provide extensively for the powers of the Inspector, to wit; the power to stop and search any person on the reasonable suspicion that such person is in possession of refined vegetable oil, to stop and search a vehicle, boat or animal carrying refined vegetable oil or products on the same reasonable suspicion, to seize and detain any oil or waste products in respect of which he/she reasonably believes that an offence has been committed against the Law or these Regulations, to arrest and detain any person that contraventions these Regulations.
