The subdivision of land so as to provide for units shall be effected by approval under the Survey Act 2010 of a plan, which shall be drafted in accordance with this Act. Upon the approval of a unit plan, a common property in the plan vests in the body corporate created on approval of the plan. The Act also provides, among other things, with respect to: the relationship between the subdivision and existing rights such as customary rights, mortgages, easements and leases; the control, management, administration, use and enjoyment of the units and the common property; transfer of rights; cancellation of a plan; further regulation of unit titles and related matters.
