Abstract

These Regulations make provision regarding an application for modification or discharge of an obligation entered into under a good neighbour agreement made pursuant to section 75D of the Town and Country Planning (Scotland) Act 1997 (as inserted by the Planning etc. (Scotland) Act 2006). The Regulations also apply the procedures contained in the Town and Country Planning (Appeals) (Scotland) Regulations 2008 to appeals made under section 75F, which enables an applicant to appeal to the Scottish Ministers in certain circumstances. Section 76D allows a person, by agreement with a community body, to enter into an obligation governing operations or activities relating to the development or use of land, either permanently or during such period as may be specified in the agreement.
