Abstract

This Order amends the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 to: update the definition of “European site”; insert new articles 7ZA to 7ZE imposing obligations on planning authorities with regard to applications by electronic communications code operators for a determination as to whether prior approval is required with regard to the siting and appearance of new ground based masts. An European site now includes also a site in the meaning of Directive 2009/147/EC of the European Parliament and of the Council on the conservation of wild birds.
