Abstract

Regulations to provide for foreign fishing in the EEZ of Tokelau. No foreign fishing craft shall be used for fishing within the EEZ except in accordance with a licence issued in respect of that craft (reg. 3). Licences may also be issued by the Administrator of Tokelau in respect of foreign vessels for which a regional fishery licence has been issued by the Agency authorized under the Treaty on Fisheries between the Governments of Certain Pacific Island States and the Government of the U.S. of 1987 (reg. 7[1]). Any licence granted under subclause (1) may be granted subject to such conditions as the Administrator thinks fit and as are specified in the licence (reg. 7[3]). No licence granted under subclause (1) shall take effect until the regional fishery licence issued in respect of the craft has taken effect (reg. 7(4)). Other Regulations provide, inter alia, for: Licensing fees (9); suspension and cancellation of licences (10); fishing for research, experimental, or sporting purposes (11); authorized officers (12) and offences and penalties (14-18).
