Abstract

The regulations define various terms related to packaging waste, including “approved person,” “consumer,” “data collection obligations,” “data reporting obligations,” “disposal,” “distributor,” “exempt packaging,” “fibre-based composite material,” “household packaging,” and many others. The aim is to improve the collection and reporting of data on packaging waste in England. The regulations also outline the obligations of producers, licensors, pub operating businesses, and online marketplace operators in relation to packaging waste data collection and reporting. Producers are required to maintain records of certain information for each data collection period and retain those records for at least 7 years. Large producers are also required to report certain information to the Environment Agency every six months. There are exemptions for certain types of packaging and packaging materials, as well as for charities. The regulations also provide for situations where a producer dies or becomes bankrupt or incapacitated.
