Abstract These Regulations, made under section 36 of the National Water Resources Management Agency Act no. 5 of 2017, provides for dam classification and safety procedure. The Regulations define: maintenance of a dam; responsibility for a dam without decommissioning and notifying the Agency; emergency preparedness and response plan; Environment Protection Agency; hazard potential. Matters covered by these Regulation include: licence applications for operating, constructing and maintaining a dam; requested documents, including: environmental assessment certificate, water quality components; holding a public hearing in case the construction and operations of the dam cause the destruction of the natural water resources and catchment, or in case of adverse effects to the community; dam classification and characteristics; safety procedures and guidelines; construction, operation and maintenance of dams; inspection programmes; safety review; licence to decommission a dam; complaints committee; offences and penalties.
