Abstract

This Regulation establishes a production insurance program, as contemplated by the Act, for the purposes of providing insurance for the kinds of loss or damage described in subsection (2). The program is also known and sometimes referred to as "AgriInsurance" or the "AgriInsurance Program". Subject to subsection (2) and section 20 and the terms of the contract, the following are designated as perils for the purpose of this regulation: (a) big game; (b) disease; (c) drought; (d) excessive heat; (e) excessive moisture; (f) excessive rainfall; (g) fire; (h) flood; (i) frost; (j) hail; (k) pests; (l) waterfowl; (m) wind, including tornado; (n) winterkill. Subject to subsections (2), (3) and (4), a person may be eligible for insurance under this regulation if (a) the person is a qualified person; (b) in the cases of vegetable acreage loss insurance and pasture days insurance, the person is an eligible person; (c) the person is 18 years of age or older; and (d) the person, in the opinion of the corporation, is legally, operationally and financially independent of all other persons engaged in farming. The corporation may, in addition to the criteria set out in subsection (1), establish eligibility criteria as a basis for determining (a) whether a person is eligible for a contract of insurance; and (b) the coverage level for which an insured person qualifies. A qualified person who wishes to obtain insurance under this regulation must complete an application for insurance and submit it to the corporation, and (a) if the person wishes to obtain vegetable acreage loss insurance, must complete a vegetable acreage loss insurance application and submit it to the corporation; or (b) if the person wishes to obtain pasture days insurance, must complete a pasture days insurance application and submit it to the corporation. The corporation must not accept a vegetable acreage loss insurance application or pasture days insurance application from a qualified person unless the person has a contract of insurance.
