Abstract This instrument confer legislative functions that are currently exercised by the European Commission (“the Commission”) to the public authorities in the United Kingdom (“UK”). Part 2 in particular refers to functions relating to aquatic animal health (Council Directive 2006/88/EC), such as requirements for aquaculture animals and products thereof, and on the prevention and control of certain diseases in aquatic animals. The new responsible authorities are: the Secretary of State, Welsh Ministers, Scottish Ministers or the Department of Agriculture, Environment and Rural Affairs. Part 3 regulates functions relating to plant health (Council Directive 2000/29/EC), specifically protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community.
