Abstract

Subsoil is the part of earth’s crust that is situated under the surface of the dry land and under the bottom of the water basins and reaches the depth accessible for geological study and exploration. Subsoil is the exclusive property of the Ukrainian people and is provided only for use. Agreements or actions that directly or implicitly violate the property rights of the Ukrainian people to subsoil are invalid (Art. 4). State Fund of Subsoil and State Fund of Mineral Deposits include both subsoil areas used and subsoil areas not involved in use, including the continental shelf and the exclusive (marine) economic zone (Art 5). Minerals by their importance are classified into minerals of national and local significance (Art 6). Subsoil users can be enterprises, institutions, organizations, citizens of Ukraine, as well as foreigners and stateless persons, foreign legal entities (Art. 13). Subsoil shall be allotted for permanent or temporary use. Subsoil use without a pre-established term is considered permanent. Temporary subsoil use can be short-term (up to 5 years) and long-term (up to 50 years). If necessary, the term of temporary subsoil use may be extended (Art. 15). The document consists of IX Sections that contain 69 Articles. Section I (arts. 1-36) lays down general provisions. Section II (Arts.37-41) regards geological study of subsoil. Section III (Arts.42-47) regards state registration of deposits, stock and exposure of minerals and the plots of subsoil conceded in use for the purposes not connected with the extraction of minerals. Section IV (Arts.48-50) regards projecting, construction and putting in operation of mining and extracting objects not connected with extraction of minerals. Section V (Arts.51-55) regards use of subsoil for the purpose of exploitation of mineral deposits and for the purposes not connected with extraction of minerals. Section VI (Arts.56-59) regards protection of subsoil. Section VII (Arts.60-63) regards state control and survey over carrying out work on geological study of subsoil, its use and protection. Section VIII (art. 64) regards dispute settlement and establishes liability for the infringement of the legislation on subsoil. Section IX (Arts.68-69) regards international cooperation.
