Abstract

There is hereby made a scheme that shall apply to all plant varieties of trees and woody climbers that conform with the characteristics of cultivated plant of any of the genera or species specified in the first column of the Schedule to these Regulations. The period for which plant breeder's rights are exercisable in respect of those plant varieties is indicated in the second column of the Schedule. Column 4 specifies the period of years prescribed for purposes of section 23 (4) of the Seeds and Plant Varieties Act. A person who infringes the plant breeder's right in the registered name of a variety of trees and woody climbers covered by the scheme here introduced, commits and offence.
