Abstract

“Seed” means any seed, including seed potatoes, which the Minister has, by Statutory Instrument, declared to be seed for the purposes of this Act. The Minister shall appoint, under section 3, an officer who shall be in charge of registering sellers of seed and seed testing laboratories in accordance with section 4. The registration officer shall issue a certificate of registration upon registration and shall state reasons for any decision on application for registration (sects. 5 and 6). Appeal against such decision may be had with the Minister pursuant to section 7. No person shall sell seed unless he is registered as a seller of seed or test seed otherwise than in a laboratory registered as a seed testing laboratory (sect. 8). Section 9 concerns the use of variety names by traders in seed. Only seed that is conform prescribed requirements and is packed in a container that meets prescribed requirements may be sold (sect. 10). The Minister may introduce, under section 12, a scheme (The “Seed Certification or Approval Scheme“) that regulates registration and approval of seeds and various other matters specified in section 13. Other provisions of this Act regulate certain aspects of importation and exportation of seed, inspection, sampling and testing of seed and prescribe offences and penalties. (28 sections)
