Abstract

This Regulation enacts section 201 of the Forest Practices Code of British Columbia Act, R.S.B.C. 1996, c. 159, with regards to silviculture and range development liabilities. Section 201 allows the Lieutenant Governor in Council to make regulations requiring security of any kind, including money, to be provided by the holder of an agreement under the Forest Act or the Range Act, to ensure the performance of an obligation arising under them. This Regulation is divided into 4 parts as follows: 1 Security for silviculture liabilities; 2 Security for range development liabilities; 3 Return of security and 4 Offence. With regards to part 1, the district manager or regional manager may, require the holder of a major licence or a woodlot licence to provide security of any kind, for the performance of the holder's duty to carry out silviculture obligations, under: (a) a silviculture prescription, or (b) a stand management prescription. The district manager or regional manager may similarly, under part 2, require the holder of an agreement under the Range Act, to provide security, for the (a) performance of the holder's duty to carry out range developments and other obligations under a range use plan, and (b) maintenance of such range developments.
