Abstract

This Notice sets out rules of conduct and general duties and specific duties (also regarding labelling of produce) of agents involved in the exportation of fresh produce (fruit, vegetables, flowers, pot plants etc.). Every export agent, other than an employee, must adopt, maintain and implement a conflict of interest management policy that complies with the provisions of these Rules. An export agent shall ensure that his employees comply with the laws, regulations and rules applicable to his occupation. An export agent must at all times have, and effectively employ such resources, procedures and appropriate technological systems that can reasonably be expected to eliminate as far as reasonably possible, the risk that principals will suffer financial loss or damage through theft, fraud, other dishonest acts, negligence or other culpable omissions. The Rules concern internal control procedures and complaint procedures. Export agents shall be certified in accordance with the Act. The Council may suspend an export agent from conducting business.
