In particular, the Regulation lays down provisions considering whether an energy resource activity is in the public interest when conducting a hearing, inquiry or investigation. Section 3 of the Regulation states that for the purposes of section 15 of the afore-mentioned Act, when the Regulator is to consider an application or conduct a regulatory appeal, reconsideration or inquiry in respect of an energy resource activity under an “energy resource enactment”, the Regulator shall take into account: a) the social and economic effects of the energy resource activity; and b) the effects of the energy resource activity on the environment.
