Resolution No. 105 of the Cabinet of Ministers validating the Procedure for felling trees and shrubs and using the extracted timber in the event of a change in the purpose of forest land plots or the establishment of servitude for their use for purposes not related to forestry management, and transfer of forest land to non-forest land.

Abstract

This Procedure establishes the requirements for felling trees and shrubs and using the extracted timber in the event of a change in the purpose of forest land plots or the establishment of servitude for their use for purposes not related to forestry management, and transfer of forest land to non-forest land. The effect of this Resolution does not apply to the harvesting of timber during felling for main use, maintenance, sanitary, reforestation, reshaping, landscape and felling related to reconstruction. In the event of a decision to change the intended use of land and forest plots in order to use them for purposes not related to forestry management, the bodies that make such a decision simultaneously decide on the issue of preserving or felling trees and shrubs and on the procedure for use of wood obtained at the same time. In the event of a decision to change the intended purpose of land forest plots for the purpose of their use for purposes not related to forestry management, with the right to cut down trees and shrubs, timber harvesting is carried out by those citizens and legal entities to whom they are transferred into ownership or provided for use such land plots, unless otherwise provided by the said decision. At the same time, the right of ownership of harvested timber and income from its sale is held by citizens and legal entities to whom ownership of such plots of land has been transferred or provided for use. In the event of a decision to change the purpose of forest land plots for the purpose of their use for purposes not related to forestry management, with the right to cut down trees and shrubs, which is granted to a permanent forest user, the owner of forests, the right to harvest timber, the right to own harvested timber and income from its sale belong to the forest owner, a permanent forest user. In the event of a decision to change the purpose of land forest plots for the purpose of their use for purposes not related to forestry management, without the right to cut down trees and shrubs, citizens and legal entities to whom land forest plots are transferred to ownership or provided for use, are obliged to ensure the preservation and care of trees and shrubs.
