Country/Territory Document type Regulation Date 2016 Source FAO, FAOLEX Subject Fisheries Keyword Marine fisheries Fishery management and conservation Foreign fishing Data collection/reporting International relations/cooperation Fishing vessel Landing Offences/penalties Abstract This Resolution of the Indian Ocean Tuna Commission (IOTC), adopted in accordance with the provisions of Article IX, paragraph 1 of the IOTC Agreement, encourages Contracting Parties (Members) and Cooperating Non-Contracting Parties (CNCPs) to undertake action against a vessel that, under international law, is not entitled to fly the flag of any State or, as referred to in Article 92 of UNCLOS, sails under the flag of two or more States, using them according to convenience. In particular Members and CNCPs shall and prohibit the landing and transhipment of fish and fish products, and access to port services, by such vessels, except where such access is essential to the safety or health of the crew or the safety of the vessel. They shall adopt necessary measures, including, where relevant, domestic legislation, to allow them to take the effective action referred above and shall exchange information.
