Abstract

The Act provides the conditions for the declaration of authorised planning authorities, including that the local authority must have staff member(s) who are town and region planners with experience in matters relating to spatial planning or the authority have contracted a town and regional planner with the same qualifications. The Act also provides the procedure for an authority to apply to be declared as an authorised planning authority. The Act provides for the preparation of the national spatial development framework, regional structure plan and urban structure plan. The plan is to contain background information including national setting and geography, major planning subjects and planning implications and conclusions. The plan is to also contain planning policies and proposals including the purpose and overall strategy, development proposals and implementation of the framework or plan. The Act encourages public participation for purposes of national spatial development framework, regional structure plan and urban structure plan through consultations with government offices, ministries and agencies as well as affected or interested stakeholders. The Act also encourages public participation through keeping records of the persons and institutions consulted and the inputs received in respect of the national development framework, regional structure plan or urban structure plan. The Act provides for zoning schemes to contain information regarding the set of clauses containing provisions prohibiting and regulating the development of land under a preliminary draft zoning scheme in the area, a scheme map showing the details of the draft zoning scheme, comments and objections received in the preparation of the scheme, a report motivating the proposals in the zoning scheme, among others. The Act provides for the procedure for lodging of deeds, plans, diagrams and other documents with the Surveyor General and Registrar of Deeds.
