Abstract

The State Inspection on Quarantine of Plants at the Ministry of Agriculture shall carry out state control measures of "external and internal quarantine" of plants for purposes of protection the territory of the Republic from penetration of foreign plant pest and diseases. It shall monitor and localise dangerous pests and diseases and eradicate them, and control the observation of established rules of quarantine during manufacture, preparation, transportation, stora ge, processing of plants, and other production of vegetative origin. The measures shall apply to categories of plants and plant products listed in section 1.2. Specific tasks of the State Inspection Service are listed in section 1.3. The State Service shall consist of the following bodies: Tajikgosquarantine, being the State inspection on the Quarantine of Plants, the Quarantine laboratory, the Fumigation Detached Office, State Inspections in autonomous Regions and Regions, District offices, and boundary offices and entrypoints (sect. 2.1). The Chief of t he Inspection Service shall act also as Main State Inspector on Quarantine of Plants. Local chiefs shall act as Main Inspectors of their respective territories (secs 2.2 to 2.4). Functions of the State Inspection are outlined in detail in section 2.5.The remaining part of Chapter 2 provides for actual inspection and specifies the plants and products subject to inspection. Powers of Inspectors are spelled out in section 2.6. Chapter 3 contains rules regarding importation of plants and plant products. Section 3.1. requires importation of plants or plant products to be accompanied any a quarantine license form importation issued by the State Inspection and a phyto-sanitary certificate of the country of origin. Additional requirements for importation are spelled out in section 3.3. Sections 3.11 to 3.15 concern the importation of seeds and planting materials and disinfecting of imported plant material. Chapter 4 contains provisions prescribing duties and rights of Government bodies and officers, other organizations, and citizens with respect to prevention and fighting of plant pests and diseases. Chapter 5 makes provision with respect legal responsibility for infringement of the Charter and rules relating to plant quarantine.
