Abstract

This Regional Law governs the relationship arising in connection with the possession, use and disposal of a special (specific) natural resource - fossil remains of mammoth fauna, as well as with the protection of the specified resource on the regional territory. It establishes legal and economic framework for a comprehensive rational use of a special (specific) natural resource – fossil remnants of mammoth fauna, protection of the specified resource and its locations, provides protection of the interests of the state and citizens of the Russian Federation, as well as indigenous small peoples of the North in the places of their traditional residence and economy. Mammoth fauna shall be considered fossil remains of mammoths, other representatives of the fossil vertebrate fauna that coexisted with mammoths in prehistoric times (woolly rhinos, bison, musk oxen, cave lions, deer and other fauna). Extraction of mammoth tusks and other remains of mammoth fauna is purposeful activity of individuals and legal entities to collect tusks from the surface of mammoth and other remnants of mammoth fauna in order to obtain the main income (profit) from economic activity. The extraction of mammoth tusks and other remains of mammoth fauna shall be performed on the basis of licenses for the use of subsoil for a specified period. The license for the extraction of mammoth tusks and other remains of mammoth fauna gives the right to buying them from natural persons and legal entities licensed for the associated collection of mammoth tusks and other fossil remains of mammoth fauna, under a sale and purchase agreement.
