Regional Law No. 17/2023-03 “On the establishment of requirements in the Moscow region, in compliance with which the territories of citizens conducting gardening or horticulture for their own needs may be included in the boundaries of the settlement or within the boundaries of the territory of citizens conducting gardening for their own needs, a new settlement may be formed.”

Abstract

This Regional Law establishes in Moscow region the requirements, under which the territory of performance of gardening or gardening by citizens for their own needs can be included in the boundaries of the settlement or within the boundaries of the territory of gardening can be formed a new settlement. Territories of gardening can be included in the boundaries of the settlement subject to the following requirements: (a) the presence of a common boundary with the settlement; (b) the area of the annexed territory, with the exception of clusters of individual housing construction, cannot exceed the area of the locality to which it joins; (c) the number of land plots with residential buildings should be at least 50 percent of the total number of land plots; (d) the presence of a decision of the general meeting of members of the horticultural non-profit partnership, horticultural or suburban non-profit partnerships on the inclusion of the territory within the boundaries of the settlement; (e) compliance with urban design standards of Moscow region to provide the planned population with facilities of social, transport, engineering infrastructure. Horticultural areas can be included in the boundaries of a locality in case of change of the type of authorized use of land plots for "gardening". Inclusion in the boundaries of the settlement of individual land plots of horticultural or gardening areas is not allowed.
