Abstract

This Regional Act regulates the collection, cultivation and trade on the regional territory of fresh or preserved truffles intended for human consumption, in compliance with the principles laid down in Act No. 752 of 16 December 1985. Fresh truffles may not be destined to human consumption unless they belong to one of the species listed out in article 2. The marketing of fresh truffles other than those listed out therein is prohibited. Annex 1 describes the botanical characteristics of such species. Gathering is permitted on natural forests and on non cultivated lands, during the periods and hours specified by article 4 and by using the instruments and methods described by article 5. Article 6 regulates the procedure to be followed to obtain the authorization to collect truffles. Further temporary prohibitions relative to gathering periods may be established by the Mountain Communities under the circumstances defined by article 8. Further provisions regard the placing on the market of fresh truffles (art. 11) and preserved truffles (art. 14), including processing (art. 12) as well as labelling and packaging requirements to be met (art. 14 and 15). The use of colouring substances is forbidden (art. 15, par. 3). The State Forestry Body is empowered to carry out inspections to ensure the compliance with the provisions hereby laid down. Article 18 sets out penalties, including the seizure of truffles unlawfully processed or marketed (art. 18, par. 1).
