Abstract

With a view to ensuring the proper exploitation of the natural heritage of the Tuscany Region, this Act encourages the rational management of the regional territory. Spontaneous flora and minor fauna are part of the natural heritage and must therefore be preserved and protected as such. The present Act also provides for the protection of forest secondary products by regulating gathering. Article 2 establishes the Regional Technical and Advisory Commission for the Protection and Preservation of Fauna and Flora. The Provinces shall provide for the setting up of similar commissions at provincial level. In accordance with article 4, the Regional Council shall approve the list of endangered plant and animal species, the gathering, capture and killing of which shall be forbidden. In addition, the Provinces shall approve the Chart for the Protection of Nature, Spontaneous Flora and Minor Fauna. Title II is concerned with particular forms of protection and plant species. Article 8 regards the inventory to be drawn up by the Provinces. Title III is entirely devoted to the protection of forest secondary products and their gathering. Firstly, article 10 determines the products which shall be covered by this Title. Further, articles 11 to 13 are concerned with incentives and subsidies. Article 15 establishes the maximum quantity of such products which may be gathered per day. Article 17 refers to particular mushroom species. Article 21 regards the collection of truffles. Title IV regards the surveillance system to be implemented in order to ensure the compliance with these provisions. Title V determines the applicable penalties.
