Abstract

The object of this Regional Act is constituted by the safeguarding and the improvement of fish species inhabiting the internal waters of the Abruzzo Region. For this purpose, the Act regulates fishing and related activities, so as to ensure the rational exploitation of fish resources. The Act consists of seven Titles. Title I contains general principles and provisions. Article 2 defines and regulates the administrative functions which belong to the Region in matter of fisheries. Nevertheless, the Region may delegate some of those functions to the Provinces. The Region and the Provinces, moreover, shall have at disposal the technical cooperation of the Regional Advisory Committee for Fisheries and the Provincial Advisory Committees for Fisheries respectively. The above-mentioned Committees shall undertake studies and research for the following purposes: (1)assessment of the consistency of fish population in the internal waters of the Region, both public and private; (2) protection of fish species; (3) regulation of the use of chemical substances which might prejudice the consistency of fish population; (4) formulation of the advices referred to in this Act. Article 4 regards the plan to be drafted and approved by the Regional Council, which shall draw up the Fishing Chart as well. The latter shall define the characteristics of watercourses so as to determine the species to be introduced. Title II lays down particular provisions in matter of fishing. A fishing licence (to be granted by the Region in accordance with the conditions and the procedure regulated under Title III) is required. For the purposes of fishing, the Regional Council shall classify the internal waters of Abruzzo into main waters (category A) and secondary waters (category B). Article 8 specifies the hunting gear and methods which are permitted. Title IV aims at the protection of fish species and regulates the management of waters. Fishing is allowed exclusively from one hour before sunrise until one hour after sunset. Article 16 prohibits fishing of certain species and during certain periods. Further provisions contained in article 16 fix the minimum size of fish species that may be harvested. Under certain circumstances and only for scientific purposes, the President of the Regional Council may authorize fishing by way of derogation from the provisions laid down in article 16. Article 18 regards the introduction of fish species for repopulation purposes. Title V sets forth provisions in matter of surveillance and lays down related penalties to be applied in case of violation of this Act. Article 25 establishes the conditions under which sport fishing competitions may be held. Moreover, article 26 refers to the regional fishing licence fee.
