Abstract This Regional Act regulates the gathering, cultivation and marketing of fresh and conserved truffles, in compliance with the principles laid down in Act No. 752 of 16 December 1985. The Act consists of 18 articles and one Annex. Research as well as gathering of truffles is free on forests and non cultivated lands, without any prejudice to the exclusive rights of the holders of such lands (art. 2, par. 1). Article 3 concerns controlled truffle cultures, which are defined as lands where truffles grow spontaneously. Paragraph 3 of article 3 lists out the improving operations that must be carried out, such as pruning, drainage of surface waters, irrigation. Article 4 concerns cultivated truffles. Article 5 regards the recognition by Decree of the President of the Regional Council of the above-mentioned truffle cultures (controlled and cultivated). The application must be accompanied by the documents and reports specified by paragraph 2 of article 5. The recognition has a duration of five years. Paragraph 5 of article 5 concerns the withdrawal of the recognition. Consortia for the protection, marketing and improvement of truffles may be established according to article 6. An authorization is compulsory for collecting truffles. Article 7 regulates the issuance of the authorization. Article 8 establishes the hours and periods during which truffles may be collected, as well as gathering modalities to comply with. Every year the Regional Council shall establish the maximum quantity of authorizations that may be granted for research and truffle gathering in regional domain forests. A special authorization may be granted to University institutes as well as cultural and research entities for educational and scientific purposes. Article 12 regulates the tax on the regional concession for research and truffle gathering. Article 13 sets out penalties. Article 14 concerns surveillance. Financial resources shall be allocated by the Regional Council for the following initiatives: a) development of research, experimentation, studies and technical assistance relating to the truffle sector; b) formative activities intended for technical staff; c) cultivation on regional lands of plants which are suitable for the improvement of truffle culture.
