Abstract

This Regional Act regulates the interventions to be undertaken for developing the forestry sector and safeguarding regional trees and flora. In addition, the Act lays down rules to arrange and coordinate fire-predicting, fire-preventing and fire-fighting activities. Article 3 defines the functions and tasks pertaining, on the one hand, to the Region and, on the other hand, to Mountain Communities and the Communes. The Regional Authority is in particular in charge of the following competences: (a) approval and updating of the Regional Forestry Plan (PFR) referred to in article 26; (b) elaboration and updating of a regional forestry information system as per article 25; c) performance of research and experimentation and drafting of projects related to forestry; d) approval of the census of protected trees and creation of the list of trees of particular importance as per article 12, paragraphs 3 and 4; e) co-ordination of fire-predicting, fire-preventing and fire-fighting activities as well as approval of the Regional Plan referred to in article 20; f) issuance of authorizations intended for the production and marketing of forest propagating material. Title I of the Act makes detailed provision in matter of forest resources, trees and spontaneous flora protection. All interventions and activities on lands protected for hydrogeological purposes as well as on forests shall be subject to the previous issuance of an authorization (art. 6). Cultural changes, felling and uprooting of plants are prohibited by article 7. Article 10 provides for the elaboration of a list of forestry operators. Article 15 regards afforestation, reforestation and tree planting. Article 17 establishes the Regional Advisory Committee and the Permanent Operating Unit (SOUP) to carry out fire-fighting activities. Title II concerns public forests. The forestry information system shall be created on the basis of the Regional Forestry Plan (art. 26) and the Regional Plan (art. 20). Title III concerns private forests. Title IV lays down provisions in matter of nurseries with a view to protecting plant biodiversity as well as genetic characteristics of forest resources. To better control the genetic quality of propagating material article 35 provides for the establishment of the Technical and Advisory Committee. Article 37 refers to the certification which is requested for the transport, marketing and any other kind of transfer of forest propagating material. Furthermore, article 38 specifies the content of the Regional Book on Forests, Plants and Seeds. Title V regards subsidies to be granted by the Region to fund the protecting initiatives hereby regulated. Title VI sets out penalties.
