Abstract

This Regional Act regulates hunting on the regional territory and lays down provisions for the protection of wildlife, in accordance with the principles set out by Act No. 157 of 11 February 1992 and by international conventions and European Community Directives (art. 1, par. 1). The Act encourages the active cooperation of local entities and agricultural and hunting associations. Interventions in the hunting sector shall be envisaged in special plans elaborated by the Regional Council (art. 1, par. 3). Any form of capture of wild birds and mammals as well as the collection of eggs and nests are prohibited throughout the regional territory (art. 2, par. 3). However, the Regional Council may authorize scientific institutes and natural history museums to capture and use mammals, birds, eggs and nests for scientific, educational and research purposes (art. 4). Article 5 regards taxidermy, which is permitted only upon registration under the competent Chamber of Commerce, Industry and Crafts and with regard to the species listed out in paragraph 3. Article 6 prescribes the content of the Regional Hunting Plan, to be approved by the Regional Council. For its implementation, article 9 sets up the Fauna and Hunting Technical Committees under the Provinces. The latter are in charge of the elaboration of special environmental improvement plants, which aim at promoting wildlife natural reproduction and introducing fauna species in order to reach the optimal density level of fauna. In addition, the Provinces shall create and manage protected areas for wildlife protection, with particular regard to migratory species. Further provisions regard repopulation and capture zones (art. 13); private and public centres intended for wildlife reproduction (art. 14), for which an authorization is compulsory; non profit fauna and hunting enterprises (art. 16); wildlife farms (art. 17). The Regional Council shall divide the agricultural and sylvo-pastoral territory into territorial hunting areas (art. 18). Hunting is allowed only to persons meeting the requirements established by Act No. 157 of 11 February 1992 (art. 22). Article 23 specifies the hunting gear that is permitted (including the use of hawks) and article 27 lists out the species that may be hunted and related authorized hunting periods. Final provisions deal with hunting permit fees (art. 34), inspections to be performed by the Provinces (art. 35), penalties (art. 37 and 38), the suspension and withdrawal of hunting permits (art. 39).
