Abstract

This Recommendation of the International Commission for the Conservation of Atlantic Tunas (ICCAT), referring to the International Plan of Action (IPOA) aiming to prevent, to deter and to eliminate illegal, unreported and unregulated fishing, defines "IUU Activities" and requires the Commission to draw up an ICCAT Draft IUU List, a Provisional IUU List and a (final) IUU List. It also requires CPCs to report on vessels flying the flag of a non-Contracting Party presumed to be carrying out IUU fishing activities in the Convention Area during the current and previous year and to undertake action upon listing of vessels that have undertaken IUU activities. Such action includes, among other things, taking of all necessary measures, under their applicable legislation: So that the fishing vessels, support vessels, refueling vessels, the mother-ships and the cargo vessels flying their flag do not assist in any way, engage in fishing processing operations or participate in any transhipment or joint fishing operations with vessels included on the IUU Vessels List; so that IUU vessels are not authorized to land, tranship, refuel, re-supply, or engage in other commercial transactions; to prohibit the entry into their ports of vessels included on the IUU list, except in case of force majeure, unless vessels are allowed entry into port for the exclusive purpose of inspection and effective enforcement action; to give priority to the inspection of vessels on the IUU list, if such vessels are otherwise found in their ports; to prohibit the chartering of a vessel included on the IUU vessels list; to prohibit the imports, or landing and/or transhipment, of tuna and tuna-like species from vessels included in the IUU list.
