Abstract This Act, comprising 72 Articles divided into ten Parts, aims to regulate the Public-Private Partnerships in the Republic of Zanzibar defined as concessions, greenfield projects, or any of these combinations, and mean any form of cooperation between one or more public authorities and one or more private partners, whereby the Private Partner (a) provides a public service or public infrastructure on behalf of the Public Authority; (b) assumes financial, technical, construction and operational risks, including demand and or availability risks, in connection with the provision of the public service or the public infrastructure; (c) receives a benefit for providing the public service or the public infrastructure in the form of payment made by the public authority from the budget of such Public Authority; (d) charges fees to be collected by the private partner from users or customers of a public service or a public infrastructure provided to them; or (e) a combination of such payment and such charges or fees. These PPPs are implemented through contractual agreements. The Public Authority is responsible for selecting the contractual form that best allocates risks and responsibilities for various PPP activities, which can include the construction and financing of new public infrastructure projects, the rehabilitation and operation of existing infrastructure, and the management of public services related to infrastructure. The forms of contracts for Public-Private Partnerships (PPPs) can be either a Concession or a Public Contract.
