Keyword Pollution control EIA Institution Offences/penalties Basic legislation Geographical area Alps, Europe, Europe and Central Asia, European Union Countries, Mediterranean, Southern Europe Abstract This Provincial Act lays down provisions in matter of Environmental Impact Assessment with a view to protecting human health as well as the environment, contributing to the maintenance of the species variety and enhancing the reproduction of the ecosystem, which is considered as an essential life resource. To this end, all projects, both private and public, which are likely to have a significant impact on the surrounding environment shall be subject to a previous environmental impact assessment. Such procedure is intended to determine, describe and valuate, as appropriate, the direct and indirect effects of a specific project over the following factors: (1) human beings, fauna and flora; (2) soil, water, air, climate and landscape; (3) cultural resources. Annexes 1 and 2 to the Act define the different projects to which the EIA shall be applied. Under certain circumstances, however, the Provincial Council may exempt particular projects from the EIA. The decision-making power pertains to the Provincial Council, which is entitled to determine, upon advice formulated by the EIA Committee, whether a certain project is compatible or not with the environment. The decision shall be published on the Official Bulletin of the Autonomous Region of Trentino-Alto Adige. Article 12 sets up the above-mentioned EIA Committee.
