Abstract

Regulations to implement various provisions of the Protection of New Plant Varieties Act, 1997 and providing, inter alia, for: fees payable under the Act (art. 3 and First Schedule); forms (art. 4 and Second Schedule); appointment of agent or representative under section 12 of the Act; application for the grant of a plant breeders' right (art. 6); proposal of variety denomination (art. 7); withdrawal or transfer of application for grant or renunciation or annulment of rights pursuant to section 19 of the Act (arts. 8 to 14).; declaration of forfeiture (art. 15); cancellation of a variety denomination (art. 6); notification of non-compliance (art. 17); invitations under section 31 of the Act (art. 18); Rejection of application or opposition to grant (arts. 19 and 20); procedures following request of annulment, etc. (art. 21); request for the registration of licence contracts or compulsory licence, cancellation of registered licence of right (arts. 22 to 24); contents of Register of Plant Breeder's Rights (art. 25); other procedures relative to the Register or communications with Controller (arts. 26 to 34).
