Necessity of mitigation action shall be determined by the Minister on the basis of certain criteria. Amendments of sections 4, 9, 8A, 9 and 10 all concern protection measures for protected species or critical habitat. Section 12 is amended so as to make statutory instrument made under this Act subject to the negative resolution procedure, unless expressly otherwise provided.
