Abstract

This Presidential Order concerns food supplements marketed as dietary foodstuffs and specifically excludes pharmaceutical products. The Order starts off with general labeling requirements which mandate that food supplements shall not be described or presented in a manner that is false or misleading, nor be presented in a way to purport to prevent, diagnose or cure any disease, among others. It further provides that the container bearing the food supplement must contain the product name, list of ingredients, packaging particulars and nutritional information. There is a requirement of registration of the food supplement with the relevant regulatory authority. The Order further places an obligation on the manufacturer to ensure the safety of the food supplements prior to distribution. The Order also covers import and distribution, storage packaging and delivery requiring. It essentially forbids food supplements from being placed on the market where they fail to fulfill any of the requirements.
