Abstract This Presidential Decree validates the Concept of efficient use of land and water resources in agriculture in accordance with the Annex 1 and "Road map" for the implementation of the Concept of efficient use of land and water resources in agriculture in accordance with the Annex 2. It estabnlishes that To establish that within the framework of implementation of the Concept, for introduction into use by rehabilitation and reconstruction of irrigation and drainage networks, introduction of water-saving technologies, as well as sowing of drought-resistant crops on the basis of investment agreement or public-private partnership for a period of up to 50 years shall be allocated: (a) irrigated land, as well as rainfed land and forest land previously removed from agricultural production - to citizens of the Republic of Uzbekistan and agricultural enterprises; and (b) pastures, deposits, perennial plantings and other land - to citizens of the Republic of Uzbekistan, agricultural enterprises, as well as investors who are residents of the Republic of Uzbekistan. In the process of introduction of land areas in agricultural production within the framework of the Concept implementation shall be applied the following procedure: (a) land users shall have the right to independently locate agricultural crops, sow crops without tillage and transfer of land to sublease; (b) the aforesaid land areas shall not be not subject to optimization, while expropriation of land plot or part thereof for state and public needs shall be allowed with the consent of the land user after full compensation of the market value of the spent funds and losses caused to owners in connection with such expropriation; (c) placement of infrastructure facilities (field mills, storage facilities, irrigation facilities and others) on these land plots shall be allowed; (d) after the expiration of the preferential period envisaged by legislation with regard to the newly tilled land plot, tax rates established prior to its putting into use shall be applied for 10 years; (e) in cases stipulated by the investment agreement or the agreement on public-private partnership, 50 percent of the costs associated with the introduction into use of each hectare of agricultural land shall be reimbursed at the expense of the State Budget of the Republic of Uzbekistan in the part not exceeding 50 times the size of the basic estimated value; and (f) land areas shall be allocated on the basis of the decision of the state body (official) authorized by the legislation after signing the investment agreement or the agreement on public-private partnership. Irrigated agricultural land shall be put under special protection, it is not allowed to allocate these land for non-agricultural purposes, including the construction of industrial and civil facilities (buildings and structures), except for the land areas allocated by the President of the Republic of Uzbekistan. Compensation payments for irrigated land expropriated for non-agricultural use shall be calculated in the amount of 10 times the amount of funds required for the development of similar new land areas, without the application of coefficients taking into account the location of the expropriated land areas, as well as in the amount of 20 times the costs associated with radical improvement of the condition of rainfed and non-irrigated land under perennial plantings, hayfields and pastures. The Concept envisages creation of a system of preferential terms for producers of agricultural commodities for the introduction of technologies to improve the ameliorative state, fertility and water supply of land previously withdrawn from agricultural production and land re-introduced in agricultural production, as well as land of the forest fund. Provision of state guarantees to business entities that have introduced, repaired or re-created unsuitable water wells, irrigation pumps, irrigation and melioration networks on the basis of an investment agreement or on the basis of public-private partnership in order to put into agricultural production of rainfed, pasture and other agricultural land.
