Presidential Decree No. 79 establishing additional measures for the implementation of Regulations (EC) Nos. 178/2002, 852/2004, 853/2004, 854/2004 and 882/2004 of the European Parliament and Council with regard to hygiene rules for foodstuffs of animal origin, the official controls on products of animal origin intended for human consumption and animal health and animal welfare rules; harmonisation of veterinary legislation to Directive 2004/41/EC.

The Decree shall enter into force on the day of its publication in the Official Gazette.
Abstract

Aim of the provisions of the present Decree is to set forth national measures adapting the requirements laid down by a number of EU Regulations and Directives with regard to hygiene rules for foodstuffs of animal origin, the official controls on products of animal origin intended for human consumption and animal health and animal welfare rules. The Decree consists of 32 articles as follows: objective (art. 1); definitions (art. 2); competent veterinary authority (art. 3); permission to authorities of member States or third country to perform a second control regarding the review of approval or provisional approval of fishing vessels (art. 4); registration and approval of food business establishments (arts. 5-7); national Catalogue of approved establishments (art. 8); cases were approval of establishments is not required (art. 9); extension or restriction of approval (art. 10); suspension – withdrawal of approval (art. 11); official controls and inspections of establishments (art. 12); procedures for imposing sanctions (art. 13); multiannual national control plans (art. 14); national guides on good practices and HACCP (art. 15); national measures for food enterprises (art. 16); delegation of competence to conduct official controls (art. 17); official controls log-book (art. 18); official veterinary officer log-book for slaughterhouses (art. 19); sampling and analysis (art. 20); laboratories of official analysis (art. 21); national reference laboratories (art. 22); crisis management (art. 23); transport of living animals and foodstuffs of animal origin (art. 24); production zones or reallocation zones of live bivalve molluscs (art. 25); training of personnel for conducting official controls (art. 26); reciprocal administrative collaboration - Community controls (arts. 27-28); sanctions (art. 29); repealed legislation (art. 30); power to the Minister (art. 31); entry into force (art. 32).
