Abstract This Presidential Decree approves the Legal Regime for the Water Captation Fee from the Water Sector. This Regime, consisting of 49 articles divided into ten Chapters and one Annex, specifies the legal regime for the water abstraction fee, payable as economic remuneration, for the use of water resources, within the scope of licences and concessions for water abstraction. The abstraction fee for freshwater has the following objectives: a) Promote the recognition of water as a natural asset of economic, environmental and social value; b) Encourage the rational use of water; c) Compensate for the benefit resulting from the private use of the water resources, the environmental cost related to activities likely to cause significant impacts on water resources, as well as the administrative costs related to planning, management, monitoring, inspection and guarantee of water quantity and quality; d) Obtain necessary funds for financing integrated management activities, protection, conservation, preservation and enhancement of water resources; e) Ensure the recovery of investments made by the State, within the framework of the of sustainable water use.
