Abstract

This Act lays down plant protection measure ancillary to EU legislation Regulation (EU) 2016/2031, Regulation (EU) 2017/625 and Regulation (EU) 1143/2014. It applies only in part to timber material and not in case plant protection measures as foreseen in the Forestry Act of 1975 are foreseen. The Act specified the competent administrative and control authorities at federal and state level for the purpose of this Act and EU legislation. The Act also specifies duties of registered operators with respect to notification of plant pests and diseases, provides with respect to exportation to third countries (Articles 100 to 102 of Regulation (EU) 2016/203, various levies and charges, further regulation by States (Länder) on plant protection to implement EU legislation, and offences and penalties.
